A New vision for 'Hostile eDiscovery'

Netmail is pioneering new technology for what might be known as “hostile eDiscovery.”

Hostile eDiscovery happens when a party who is adversarial to the management of an enterprise conducts a search for records, without the cooperation of management. Examples of adversaries might be:

  • Law enforcement like FBI or the Royal Canadian Mounted Police
  • Tax collector like the Internal Revenue Service, Revenue Canada, or a state tax authority
  • A regulator like the Environmental Protection Agency or the Food and Drug Administration
  • A fraud investigator hired by the board of directors of a public company to investigate whether management is stealing from the company

Companies across the globe are reporting that they have been struck by a major ransomware cyber-attack today, similar to the cyber-attack we blogged about last month. Ukrainian firms, including the state power company and Kiev's main airport, were among the first to report issues. With Interpol "closely monitoring" the situation and liaising with its member countries, experts suggest that the malware is taking advantage of the same weaknesses used by the Wannacry attack last month.

Netmail 6.1 - ediscovery in exchange or office 365

Netmail 6.1 is now available in beta. Netmail 6.1 adds the capability to index and search data that is stored in your mail server. You no longer need to wait for the archive jobs to run see your data. You can perform your eDiscovery on emails wherever they are stored. Netmail 6.1 also improves security by trying administrators to AD groups and AD authentication. All administrator actions are also logged allowing traceability of actions.

Data Security vs Computer & Network Security

RSA is going on this week. RSA is the big yearly gathering of security vendors and specialists where training and discussion take place big time. When I think about RSA, an image comes to mind. A few years back, during the opening Keynote, Art Coviello, the CEO of RSA, came onstage and made a presentation that left everyone with a strange feeling. For twenty minutes, he made the case for how the security industry was failing. He showed statistics about how data breaches were going up, how there were more vendors in the industry, and how more money was being spent on security without a valid return on investment. What was unsettling is that he did not present any solutions to the problem. He was basically presenting the problem to the audience, who he considered the most important security experts in the industry.

I spent last week at Legaltech 2017, and as usual, when you travel out of the office, you often gain a new perspective on things. The show’s focus was all about eDiscovery. The eDiscovery Reference Model (EDRM) has been a great guide to create a common language of what legal teams with an inside council or outside council are required to do as they prepare a case. The EDRM model, and the organization, has been such a good reference that the terminology and structure has been adopted by internal investigations, information governance, and information security. This has also attracted new technologies that question the current model by bringing exciting new innovations to the market.
